Protection of personal data

At VIVANTIS, as, IČO: 25977687 (hereinafter referred to as "we"), we pay great attention to the protection of personal data. In this document, you will find information about what personal data we process, especially about our customers and users of our website, whether we process data on the basis of consent or on the basis of another legal reason, for what purposes we use it, to whom we can pass it on and what you have in connection with processing your personal data rights.

1. What personal data do we process?

When you use our services, we collect various types of data, such as your contacts and other settings. We track which products you view on our website and from which device, which of our e-mailed offers interested you, and derive additional data about you from this in order to show you tailored offers and to further improve our website in the future. If you buy from us, we also work with your first and last name and your orders.

We process the following personal data:

• contact information, which means personal information that allows us to contact you, in particular email address, telephone number, delivery address and your contact on social networks;

• your settings, meaning newsletter settings, monitored products (so-called watchdogs);

• data about your orders, which are in particular data about the goods and services you have ordered, the method of delivery and payment and data about complaints;

• data about your behavior on the website, including when you view it through our mobile application, in particular the goods and services you view, the links you click on, the way you move around our website and scroll the screen, as well as data about the device from which you view our website, such as the IP address and the location derived from it, device identification, its technical parameters such as the operating system and its version, screen resolution, the browser used and its version, as well as data obtained from cookies and similar technologies for device identification;

• data about your behavior when reading the messages we send you, in particular the times of opening the messages and also data about the device on which you read the messages, such as the IP address and the location derived from it, the identification of the device, its technical parameters such as the operating system and its version, screen resolution, browser used and its version;

• derived data, which means personal data derived from your settings, data about the goods and services you purchase from us, data about your behavior on the website and data about your behavior when reading emails we send you; in particular, this is data about your gender, age, financial situation, purchasing behavior and relationship to various goods and services;

• data related to the use of the call center or a visit to the store, which are in particular records of phone calls with the call center, identification of messages you send to us, incl. identifiers such as IP addresses and recordings from in-store camera systems.

 

2. Why do we process personal data and what authorizes us to do so?

We process your personal data in different situations for different purposes. If you use our website, on which we also use cookies, we use your data mainly to monitor traffic and improve our services. If you make a purchase from us, we use your information to process your order, protect our legal claims and fulfill our legal obligations. We also display and send you our customized offers, unused discount coupons and unfinished purchases with the help of your contacts and other data. With your consent, we transfer data to third parties to display offers on other websites and also to make some additional services available to you. We are authorized to process personal data either for the preparation or performance of a contract with you, compliance with legal obligations, our legitimate interests or your consent.

As part of our activity, we process personal data for various purposes and to varying extents either:

• without your consent based on the performance of the contract, our legitimate interest or due to the fulfillment of a legal obligation, or

• based on your consent.

What kind of processing we can carry out without your consent depends on the purpose of the respective processing and in what position you are in relation to us - whether you are just a visitor to our website or you register or make a purchase with us. We may also process your data if you are the recipient of goods or services ordered from us, if you communicate with us or if you visit our store.

 

2.1. If you visit our website

 

2.1.1. Use of cookies and other technologies, transfer of data to advertising and social networks

If you visit our website, we store and then read small files such as cookies on your device. A cookie is a small file of letters and numbers that we store in your Internet browser or on your computer's hard drive. Some cookies allow us to link your activities while browsing our site from the moment you open a web browser window to the moment you close it. The moment you close the Internet browser window, these cookies are deleted. Others remain on the device for a set period of time and are activated each time you visit the website that created the particular cookie. We also use pixel tags Facebook, Criteo, Sklik (List), AdWords (Google), RTB House, Smartmailing (SmartSelling as), Glami, Zbojí and Heureka (also known as web beacons), which are small images that have a similar function as cookies. Unlike cookies, which are stored on your computer's hard drive, pixel tags are a permanent part of the website. For the sake of simplicity, we will further refer to all these technologies as cookies in this document. We not only store cookies on your device, but also read the cookies that our website has stored on your device. For the sake of simplicity, we will only talk about storage in this document.

Some cookies are stored directly on your device by our website. These cookies help us:

• to identify you when you move between individual pages of our website and when you visit again, for example so that your shopping cart is not deleted when you make a purchase, so that we can remember your login from a specific device and not repeatedly ask you for your e-mail and password, or to save which to show you the version of our website if the website currently offers more than one version;

• record that you have given us your consent according to this document, or whether, for example, you have offered to participate in a certain survey;

• to ensure security, for example to investigate whether someone has misused your connection to our website and is acting on your behalf;

• record, investigate and eliminate malfunctions and non-functional parts of our website.

Such cookies and other files are necessary for the functioning of our website. If you block these cookies in your browser, our website may not function properly and we may not be able to provide you with our products and services.

Next to your device:

• we store cookies from our website that allow us to:

   • monitor the traffic of our website, its individual pages, create statistics and reports and measure the effectiveness of advertising;

   • show you different versions of our website if we are testing new functionalities;

   •  customize the content of our website for you, for example to show you products you have already viewed and show you more tailored offers on our website;

• we allow cookies to be stored by third parties who can use them:

   • to collect data about your behavior on our website and on other websites;

   • to display customized offers and targeted advertising within advertising and social networks on websites other than our website;

   • to connect with social networks such as Facebook, including automatic login, providing features such as the "Like" button and displaying customized offers and targeted advertising on these social networks and websites other than our website.

In order to display customized offers and targeted advertising within advertising and social networks on websites other than our website, we also transmit data about your behavior on the website to advertising and social networks. However, we do not share your identification data with such partners. If you do not turn off the use of third-party cookies and the transfer of your data to advertising and social networks in the Privacy Settings section, and after our notification you click on any link on our website (outside the notification panel) or click on the "I understand" button that is part of the notification, we will have for this, you agree to the use of these cookies and the transfer of your data to advertising and social networks. You can withdraw your consent at any time by turning off this feature in the Privacy Settings section.

 

2.1.2. Use of personal data of website visitors

If you visit the sefiros.eu website, we process data about your behavior on the website based on our legitimate interest (i.e. without your consent) in order to:

• obtaining information on the basis of which we can improve the website for you in the future, so that you can shop with us even better; our legitimate interest here is to improve our services to you;

• creation of statistics and overviews, in particular monitoring the traffic of our website, its individual pages and measuring the effectiveness of advertising; our legitimate interest here is to measure the effectiveness of our website and advertising spend; for this purpose we may obtain additional derived data from your behavior on the website and use it for this purpose;

• testing new features and applications before deployment, in particular to avoid problems with the functionality of these innovations in real operation that could impair your shopping experience with us; our legitimate interest here is the smooth functionality of our services for you;

• preventing attacks on our website and jeopardizing its functionality and the security of your data; our legitimate interest here is the trouble-free functionality of our services for you and the security of your data.

We do not only obtain data about your behavior on the website from cookies. We also supplement them with data:

• The IP address of your device (the address of your device that you use to communicate with other devices on the Internet);

• your device's operating system, its version and language settings;

• the browser you use on your device, its version and language settings;

• the website address (URL address) from which you come to our website.

We use personal data for these purposes for a maximum of 38 months. You have the right to object to this processing.

We also process data about your behavior on the website based on our legitimate interest (i.e. without your consent) in order to create customized offers and targeted advertisements that we display to you on the website. Our legitimate interest here is a maximally personalized and effective offer for you. For this purpose, we also enrich the named data with the help of analysis and obtain derived data from them. According to this data, we also divide our users into different groups, with each group receiving its own specific offer. If you subsequently make a purchase from us, we also use data about your orders for these purposes.

We use personal data for these purposes for a period of 38 months. You can turn this feature off at any time in the Privacy Settings section.

 

2.2. If you buy from us

In order to make a purchase from us, you must visit our website, therefore the processing described in the section If you visit our website applies to you. If you make a purchase from us, we also carry out the following processing:

 

2.2.1. Processing based on contract performance

If you make a purchase from us as a natural person, we process your personal data for the purpose of processing your order, your identification and contact data and data about your orders. If you have a user account with us, we may also use your settings for this purpose.

If you purchase from us as a representative of a legal entity, we process the same data for the same purpose based on our legitimate interest in concluding and fulfilling a contract with the person you represent.

The fact that we use this data for the purpose of processing your order means that we use it in particular:

• so that you can complete your order on the website, for example, so that the goods placed in the basket are not deleted, or the data from the order in progress;

• so that we can communicate with you about the order, for example, to send you a confirmation of the order or to notify you about the shipment of the goods;

• for the needs of payment for goods, including provision of deferred payment; in this context, we may also transfer your data to our partners operating payment systems or providing deferred payments, as described in Who processes your personal data and to whom do we transfer it?;

• for the needs of delivering goods; in this context, we may also transfer your data to our shipping partners as described in Who processes your personal data and to whom do we transfer it?;

• in connection with complaints about ordered goods or services; in this context, we may also transfer your data to a supplier of goods or a service center as described in Who processes your personal data and to whom do we transfer it?;

• in connection with your other requests, which you contact us with, for example, using the call center, as described in the section If you communicate with us through different channels.

• In connection with sending unused discount coupons

• In connection with sending an unfinished purchase

For this purpose, we use personal data for the time necessary to process your order, or settlement of a contractual claim, such as a complaint.

 

2.2.2. Processing based on legitimate interest

If you make a purchase from us, we will retain your identification and contact details and your order details based on our legitimate interest (without your consent) for the purpose of protecting legal claims and our internal records and controls. Our legitimate interests here are the protection of legal claims and the control of the proper provision of our services.

Furthermore, based on our legitimate interest (i.e. without your consent), we process your identification and contact details, your settings and your order details (if you later purchase from us) in order to:

• obtaining information on the basis of which we will be able to improve our services for you in the future to make your shopping experience even better, in particular to determine your satisfaction with our services; our legitimate interest here is to improve our services to you and

• adapting the features of our website to your needs, based on our legitimate interest in improving and customizing our services; for this purpose we also process your IP address and the location derived from it,

• providing you with tailored offers and targeted advertising that we may send to you by email, text message, social media, telephone or other electronic means, or mailed to you; our legitimate interest here is the effective promotion of our products and services, including informing you about the non-use of discount coupons or your unfinished purchases. In order to be able to prepare a tailor-made offer for you, we analyze the above data (i.e. your identification and contact data and data about your orders) and obtain additional derived data from them, which we use for this purpose. According to this data, we also divide our users into different groups, with each group receiving its own specific offer.

Therefore, if you have purchased a perfume from us, we can contact you with a targeted offer for the promotional price of the item. We can also infer from your purchase which customer group you belong to and accordingly send you an offer for related products that may be of interest to you.

In order to create customized offers and targeted advertisements that we show you on the website, as described in If you visit our website, we will also use data about your orders.

Based on our legitimate interest (that is, without your consent), we will also use your settings to test new features and applications before deployment, as described in If you visit our website.

In the event that you decide to use deferred payment using the Skip Pay service, we will transfer your identification and contact data, IP address, data about your order and the volume of previous purchases to Home Credit as for the preliminary assessment of whether you are entitled to deferred payment, for the purpose of fraud prevention and assessment of willingness and ability to repay. We carry out the handover on the basis of the legitimate interest of the company Home Credit as consisting in protection against fraudulent behavior and unpaid claims.

In order to protect legal claims and our internal records and control, we process data for the duration of the limitation period of 3 years and one year after its expiry with respect to claims made at the end of the limitation period. In the event of the initiation of judicial, administrative or other proceedings, we process your personal data to the extent necessary for the entire duration of such proceedings and the remaining part of the limitation period after its termination.

For the other stated purposes, we use personal data for a maximum period of 38 months.

You have the right to object to this processing carried out on the basis of our legitimate interest.

 

2.2.3. Processing based on the fulfillment of legal obligations

We also have to fulfill certain statutory obligations. If we process your personal data for this very reason, we do not need to obtain your consent for such processing. On this legal basis, we process your identification and contact data, order data, in order to comply with the following laws in particular:

• Act No. 89/2012 Coll., Civil Code,

• Act No. 634/1992 Coll., on consumer protection,

• Act No. 235/2004 Coll., on value added tax,

• Act No. 563/1991 Coll., on accounting.

For these purposes, we use personal data for a maximum of 10 years.

 

2.3. If you are the recipient of goods or services ordered from us

If you are the recipient of goods or services ordered from us, we process your identification and contact data:

• on the basis of our legitimate interest for the purpose of preparing, concluding and fulfilling a contract with our customer. Fulfilling this contract is also our legitimate interest;

• based on our legitimate interest in obtaining information on the basis of which we can improve our services in the future, or information for the creation of our internal statistics and reports; our legitimate interest here is to improve our services to our customers;

• for the purpose of fulfilling legal obligations in particular according to Act No. 235/2004 Coll., on value added tax and Act No. 563/1991 Coll., on accounting;

• for the purpose of protecting legal claims and our internal records and controls; our legitimate interests here are the protection of legal claims and the control of the proper provision of our services.

For the preparation, conclusion and fulfillment of the contract with our customer, we use personal data for the time necessary to process the order. After the expiration of this period, we will continue to retain the data based on our legitimate interest for the purpose of protecting legal claims and our internal records and control, for the duration of the limitation period of 3 years and one year after its expiration with regard to claims made at the end of the limitation period. In the event of the initiation of judicial, administrative or other proceedings, we process your personal data to the extent necessary for the entire duration of such proceedings and the remaining part of the limitation period after its termination. Our legitimate interests here are the protection of legal claims and the control of the proper provision of our services. For the purposes of fulfilling legal obligations, we use personal data for a maximum of 10 years.

You have the right to object to this processing on the basis of corrective interest.

 

2.4. If you communicate with us through different channels:

If you communicate with us through various channels, especially through the call center, email, and social networks, we will process your identification and contact data and records of the communication, including call recordings, based on our legitimate interest (ie without your consent) for the purpose of:

• processing your requests; if you have purchased from us and your request relates to an order, we can implement this processing based on the performance of a contract with you;

• records of your requests so that we can check that we fulfill them properly and on time;

• proving that we have accepted and processed your request, e.g. when you order some goods from us in this way or make a complaint;

•   their analyzes to improve the quality of our services.

For these purposes, we store personal data for 3 months. If you place an order with us using one of the channels, we may retain the data for the protection of legal claims for the duration of the limitation period of 3 years and one year after its expiry with regard to claims made at the end of the limitation period. In the event of the initiation of judicial, administrative or other proceedings, we process your personal data to the extent necessary for the entire duration of such proceedings and the remaining part of the limitation period after its termination.

You have the right to object to processing based on our legitimate interest.

 

2.5. If you visit our store or its surroundings:

If you visit our store or its surroundings, we will process a recording from the camera system on which you may be captured, based on our legitimate interest (ie without your consent) in order to protect our and your property and people moving in and around the store , which is also our legitimate interest.

For this purpose, we store personal data for 14 days.

You have the right to object to this processing.

 

2.6. If you give us your consent

 

2.6.1. For deferred payment with Skip Pay

If you want to use a deferred payment using the Skip Pay service, we will pass it on to Home Credit as described in When you shop with us. If you want to increase your chances of getting a deferred payment option, we may also pass details of your other orders and data about your behavior on the website (including your device data) to Home Credit a.s. with your consent, for the purpose of preventing fraud and assessing willingness and ability repay. This transfer of data is one-time and we do not store the data further or use access to your location, so your consent cannot be revoked against us. You can find out how to exercise your rights vis-à-vis Home Credit a.s. in the Information on the processing of personal data in Skip Pay.

 

3. Who processes your personal data and to whom do we pass it on?

In most cases, we process your data for our own purposes as its controller. In this case, we transfer your data to our partners to ensure payment, transport and other details of your order. We also transfer the data to our processors, who process it according to our instructions. With your consent, we can also pass on the data to advertising and social networks for the display of tailored advertising on other websites and to our partners to assess the right to deferred payment.

All mentioned personal data are processed by us as the administrator. This means that we determine the above-defined purposes for which we collect your personal data, determine the means of processing and are responsible for their proper execution.

We may also transfer your personal data to other entities that are in the role of administrator, namely:

• in connection with the processing of your order to our partners who participate in this processing, as stated in the section When you buy from us, specifically

   • to partners operating payment systems for the purpose of ensuring payment, especially in connection with card payments, in particular to the companies Československá obchodní banka, a.s. 4. From what sources do we obtain personal data?

We usually obtain personal data directly from you through our website or when communicating with you. We may also receive some additional data from our partners, e.g. banks or shipping companies.

In most cases, we process personal data that you provide to us as part of ordering goods or services, or when communicating with us, for example at the call center. We also obtain personal data directly from you by monitoring your behavior on our website and when reading news, by recording calls to the call center and by camera recording of our branches and their surroundings.

If you make a purchase from us, we may receive additional data about your orders from banks, our partners operating payment systems, transport partners, for example information about your account number, successful payment, or delivery and receipt of goods in connection with the performance of the concluded purchase contract.

 

5. Transfer of data outside the EU

In some cases, we may also transfer your personal data to countries that are not part of the European Economic Area.

As part of the transfer of data to our processors, listed in the section Who processes your personal data and to whom do we transfer it?", we may also transfer your data to third countries outside the European Economic Area that do not ensure an adequate level of personal data protection. 6. What rights do you have when processing personal data?

You have a number of rights in relation to your personal data. This is the right of access, correction, erasure, restriction of processing, portability, objection and complaint.

Just as we have rights and obligations when processing your personal data, you also have certain rights when processing your personal data. These rights include:

 

6.1. Right of access

Simply put, you have the right to know what data we process about you, for what purpose, for how long, where we obtain your personal data, to whom we pass it on, who processes it outside of us and what other rights you have related to the processing of your personal data. You can find out all this in this document "Customer privacy protection". However, if you are not sure which personal data we are processing about you, you can ask us to confirm whether or not personal data relating to you is being processed by us and, if so, you have the right to access that personal data . As part of the right of access, you can ask us for a copy of the processed personal data, whereby we will provide you with the first copy free of charge and additional copies with a fee.

 

6.2. Right to rectification

To err is human. If you find that the personal data we process about you is inaccurate or incomplete, you have the right to have it corrected or supplemented without undue delay.

 

6.3. Right to erasure

In some cases, you have the right to have your personal data deleted. We will delete your personal data without undue delay if any of the following reasons are met:

• we no longer need your personal data for the purposes for which we processed them;

• you revoke your consent to the processing of personal data, in the case of data for which your consent is necessary for processing and at the same time we have no other reason why we need to continue processing this data;

• you exercise your right to object to processing (see Right to object to processing below) for personal data that we process on the basis of our legitimate interests and we find that we no longer have such legitimate interests that would justify such processing, or

• you believe that the processing of personal data carried out by us is no longer in accordance with generally binding regulations.

But please keep in mind that even if it's one of these reasons, it doesn't mean we'll delete all your personal data right away. This right does not apply if the processing of your personal data is still necessary for the fulfillment of our legal obligation or the determination, exercise or defense of our legal claims (see the section Why do we process personal data and what authorizes us to do so?).

 

6.4. Right to restriction of processing

In some cases, in addition to the right to erasure, you can use the right to restrict the processing of personal data. This right allows you to request in certain cases that your personal data is marked and that these data are not the subject of any further processing operations - in this case, not forever (as in the case of the right to erasure), but for a limited period of time. We must limit the processing of personal data when:

• you dispute the accuracy of personal data before we agree what data is correct;

• we process your personal data without a sufficient legal basis (e.g. beyond what we have to process), but you will only prefer to limit such data before deleting it (e.g. if you expect to provide us with such data anyway in the future);

• we no longer need your personal data for the above processing purposes, but you require it for the determination, exercise or defense of your legal claims, or

• you object to the processing. The right to object is described in more detail below in the chapter Right to object to processing). For the period during which we save, if your objection is justified, we are obliged to limit the processing of your personal data.

 

6.5. Right to portability

You have the right to receive from us all your personal data that you yourself have provided to us and which we process based on your consent (see section If you give us your consent) and on the basis of the performance of the contract. We will provide you with your personal data in a structured, commonly used and machine-readable format. In order to be able to easily transfer the data at your request, it can only be data that we process automatically in our electronic databases.

 

6.6. The right to object to processing

You have the right to object to the processing of personal data based on our legitimate interest (see the section Why do we process personal data and what entitles us to do so?). In the case of marketing activities, we will stop processing your personal data without further delay; in other cases, we will do so unless we have serious legitimate reasons for continuing such processing.

 

6.7. The right to file a complaint

Exercising your rights in the above manner does not in any way affect your right to file a complaint with the relevant supervisory authority. You can exercise this right in particular if you believe that we are processing your personal data unlawfully or in violation of generally binding legal regulations. You can file a complaint against our processing of personal data with the Office for Personal Data Protection, located at the address Pplk. Sochora 27, 170 00 Prague 7.

The fastest way to apply and request the exercise of rights on Vivantis.cz is by filling out the web form under link personal data management

If for any reason you cannot use the form on the above link, you can also send the request via the company's mailbox, or in paper form to the address of the company's headquarters. In such a case, however, your application must be accompanied by an officially verified signature.

We will process your request without undue delay, but within one month at the most. In exceptional cases, especially due to the complexity of your request, we are entitled to extend this period by another two months. Of course, we will inform you about such a possible extension and its justification.
